ALBANY - Restaurants and bars this week will begin asking customers to help fund a lawsuit seeking to strike down the looming statewide ban on smoking, The Post has learned.

Customers will be able to buy "Ballots for Freedom" for $1, sign them, and have them posted on the bar or restaurant wall where they purchased it.

The tavern association yesterday began distributing the Ballots for Freedom to its 5,000 members, with the idea that if each bar and restaurant sells 100, they'd meet the $500,000 target.

If all smokers in each establishment would donate the price of a pack of cigarettes they would far exceed that goal.

The majority of the Maine lawmakers have done the same thing. No smoking in bars/taverns is due to go into affect in September and/or January.

Many of us in Maine are working to over turn this asinine law.

And the same thing is being done in Delaware to overturn that assinine law, as well.

I would too. But it's a pretty sad day when American's have to start to pay for personal freedoms.:(

Wexler said his organization will challenge the smoking ban on three main issues: that the law is constitutionally vague, takes away property rights from restaurant and bar owners, and interferes with interstate commerce.

Excellent basis for a challenge to the ban, but "Money/Power/Politics" beat "Constitutional Freedom" every day. I hope the bar owners succeed!

Nice dog is correct. Ugly old hairy addle brained smoking man is acceptable. She is a cute little labmix isn't she. I call her a Labradaniel. Some smoke nazi will spot the pic someday and call the ASPCA. I'll kick their butts too.
